All we are asking is to support some kind of action against the USCIS...
we just need to mobilize ourselves... this is not a fight for EB-2 or EB-3... but for the whole legal immigration system... let's just do something
we are looking at specific situations where the legal immigrant community was affected... and right now its the non sequential processing of the applications for EB-2...
for EB-3 we will need to make similar points which we can raise with Ombudsman or some other authority... we just need to find instances where people were affected... for example delays in EAD.. and that is for EB-2 and EB-3

Section 202 of the Immigration and Nationality Act (INA) states that the per-country limit for preference immigrants is set at 7% of the total annual employment-based preference limits. This means a country with large population like India and a tiny country like Lichtenstein get same number of visa numbers. This system is designed to systematically discriminate people from India and China by preventing them from attaining employment visas. More research needs to be done whether this constitutes a violation of US Equal Employment Opportunity Law. We need to find out whether this constitutes discrimination by national origin. The point system has worked well in both Canada and New Zealand and have moved those who meet the threshold through the immigration system faster. As an non paying IV member, I am not in favor of opposing the current bill.
Where did you get this idea that IV is opposed to the point system? Any reference to the IV analysis or the core member response would be appreciated before you put such a claim.
We have identified our objectives clearly. Taking a position for the bill (in favor of or in opposition to) does not neccesarily mean that we want to kill this bill, but instead we like the congress to treat this community fairly and at parity with the undocumented immigrants and family-based applicants in the current Immigration Reform bill S. 1348.

Anybody who filed after 06/04/2007, got receipt#
I am just trying to see if NSC could go past the I-485 received on 06/01/2007. Many folks whose application was received the first day got receipt and receipt#. Is there anyone who applied later and got the receipt or receipt#.
I know atleast 5 friends whose applications reached NSC on 06/04/2007. No updates yet. I am very +ve they will soon as they are even working weekends....

Gurus,
I have a unique position. couple of weeks back I was told that have fatal cancer and won't live pass 4-6 months. After recovering from initial shock I am wondering if my wife will be able to continue her american dream or she will have to head home after me.
I have filed 485 with approved 140 back in june, 2007 with PD of March, 2003
Please help.

I cannot tell you how sorry I am for your current situation. Please don't give up and consult other physicians. I personally know couple of people who were scared by the doctors about having a serious health condition but they totally recovered and are fine now. The doctors here just alert you about the worst that could happen to save themselves from being sued. So please don't lose hope and try other methods.
I am sure USCIS will consider your situation and your wife will get her GC without any problems. You just have to go in the right route. Contacting an attorney would be the way to go.

Thanks for starting the thread. I share your grief and agree that we gotta do something. As much as I agree that we have to fight for our rights, I am not too sure if suing is the best option.
Again, if you all decide too, I will be more than glad to contribute my 100 but do we have enough ground to ask the questions in such 'blunt' manner? As much as you and I believe that our lives are completely topsy-turvied by these arcane policies, would some one arguing against our claim say that we are still entitled to do what we were allowed here to do. The employment visa allows us to work in a certain kind of job and nothing is hampering that aspect. Yes, it screws up promotions, displaces your plans to stay and has ill-effects both at a personal as well as professional levels but still..
If we have to sue, I think the ground work one has to do is immense. Find significant amounts of data from USCIS in terms of how random their approvals are and how it affects you after we all paid monies expecting a totally different pattern. If this can be accomplished, we could sue them probably for their lack of customer service, by-passing their guidelines on a consistent basis and thus hampering the lives of several people who were here for example in 2001, etc. I strongly believe data is our best friend (worst too, as it is personal data that we probably might not be entitled to even enquire..)
Again, I am no lawyer. I am sort of playing devil's advocate and just thinking through the obvious rebuttals. If we were too get enough data, combining that with active media publicity and some innovative ideas (flowers/clocks/watches whatever) or getting the businesses to acknowledge, then we may see certain changes.
I don't mean to damper your spirits by any sort. I certainly like the 'return my money if you fail to live by your own guidelines'.

(I had posted a similar note a couple of weeks ago. I apologize for doing so again, but I feel this needs to be said).
We legal immigrants need to make our voices heard because 99% of the US Citizens do not know our (sad) story. Here are some highlights (nothing new to the users of this site):
1. Most of us are highly educated.
2. .. work hard (because otherwise why would our employers sponsor us).
3. .. follow all the laws and pursue legal immigration.
4. .. are deeply invested in this country - so many of us own houses, mutual funds, etc. that are investments in the Economy.
5. .. contribute to the society in a variety of ways including: paying taxes, inventing so much of the new technologies (especially in the computer industry).
It wouldn't be too hard to get statistics on how much employment-based immigrants contribute to the economy - number of companies started by former immigrations, number of patents filed, US citizens employed by such companies, correlation of the growth of the Computer Industry with Employment based Immigration. I believe a very strong case can be made in our favor.
And all we ask for is a fair shot at permanent residence in this country. Not only do we not get that, the process is opaque and we have NO idea how long it may take for us to navigate each one of the many stages of this process. The process is completely unbounded and we have no way to planning our lives.
I bet if the US Citizens at large find out what we go through day-to-day they would be appalled. One way to do so is to peacefully protest in public - perhaps outside the USCIS offices. It is probably a dumb idea, but I wanted to bring it up - let us not sell our selves short, there are a lot of us and if we combine our voices it would be loud enough to get to the right ears. I am sure we will see action.
